By downloading or using HappensNightly (the "App"), you agree to these terms. Please read them carefully.

License

HappensNightly grants you a personal, non-exclusive, non-transferable license to use the App on Apple devices you own or control, in accordance with the Apple Media Services Terms.

Not a medical device

HappensNightly is for general informational and wellness purposes only. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition. Always consult a qualified healthcare provider regarding any sleep or health concern. Do not rely on HappensNightly for medical decisions.

HealthKit data

The App reads sleep and related health data from Apple HealthKit with your permission. You are responsible for the accuracy of the underlying data in Apple Health. HappensNightly displays and analyzes whatever Apple Health provides — it does not measure or generate sleep data on its own.

Your content

Journal entries you create remain yours. They are stored on your iPhone. We do not access, view, or transmit your journal content.

Acceptable use

You agree not to:

• Reverse-engineer, decompile, or attempt to extract source code from the App, except as expressly permitted by law.
• Use the App in any way that violates applicable law or the rights of others.
• Redistribute, sell, lease, or sublicense the App.

App Store

The App is distributed by Apple via the App Store. Your purchase, refund, and account terms with Apple apply alongside these terms. Apple is not responsible for the App or its content.

Disclaimer of warranties

The App is provided "as is" without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. Use of the App is at your sole risk.

Limitation of liability

To the maximum extent permitted by law, in no event shall the developer of HappensNightly be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, sleep, or health outcomes arising from your use of or inability to use the App.

Changes

These terms may be updated from time to time. Continued use of the App after a change constitutes acceptance of the new terms.

Governing law

These terms are governed by the laws of the State where the developer resides, without regard to its conflict-of-law provisions.
